The terms below are designed to serve as a guide to any user of our website(s). They outline the conditions that must be complied with by any user of this Site and forms a legally binding agreement between The Care Business Academy(TCBA)and the third party (“service User”). Whenever you use our services, you confirm that you agree to be bound by our Terms and acknowledge any changes to them.
We may from time to time, change, amend or alter some parts or whole of the Terms and conditions, which will be made effective, immediately. Once these are done, they will be posted on our website for the information of all users.

If you fail to agree these Terms and conditions, please do not use our website or any of our affiliate sites.

2.0 The Terms
2.1 Eligibility

Our services are available to all individuals who are 18 years old and above, who can be the subject of a contractual agreement with a third party. TCBA may, using its discretion, decline to offer services to any service user or may decide at any time to change its criteria for service provision without recourse to any individual.

2.2 Accessibility

This Site is available to all users. However, TCBA reserves the right to modify, replace, change, suspend or in fact, discontinue its services by mass announcement at the Site or through individual contact details. TCBA also reserves the right to restrict, delete or deny access to individuals or service users who blatantly disregard our Terms of Use, either through the production, replication or introduction of any material, content or activity that is deemed as being contrary to the principles, values and ethos upon which this Site is formed.

A Service User may browse the Site without necessarily registering their personal details. However, as a condition of usage by individuals wishing to use the Site as a platform for business conduct, etc, it is a condition of the Terms of Use to register with TCBA and select a screen name and password. Failure to provide complete, accurate and updated information shall constitute a breach of the Terms of Use, which will result in the instant termination of the individual or company’s account.

3.0 Rules of Conduct
All entrepreneurs, clients, consultants are responsible for their own activity in relation to these services. For this reason, TCBA is in no way, manner, form or shape, responsible for user submissions, videos, audio clips, written forum comments, information, data, text, photographs, software, scripts, graphics and interactive features generated, provided or otherwise made accessible by TCBA or any of its partners on or through the services provided. By using the Site, you promise to abide by all Terms of Use and not to use the Site for any purpose that is prohibited by the Terms of Use. For the avoidance of doubt, TCBA does not encourage and will do anything possible to ensure that materials and information posted on the Site are genuine, authentic and original from the source. Service users are not permitted to:

i)infringe any patent, trademark, trade secret, copyright, right of publicity or other right of any other person or entity or violates any law or contractual duty;

ii)submit information that they knowingly are aware to be false, misleading, untruthful or inaccurate;

iii)submit material or information that is unlawful, threatening, abusive, harassing, defamatory, slanderous, deceptive, fraudulent, invasive of another person’s privacy, etc.

iv)Submit unsolicited or unauthorized advertisement or promotional material or any material deemed to be spam, junk or virus-prone which has the effect of disrupting, damaging, limiting or interfering in the use of information and contents on the Site.

4.0 Guarantee of Site content
TCBA does not guarantee that any content or submissions made by any service user(s) will be made available. TCBA is not obliged to monitor the Site, its contents and User submissions, although, for the sake of integrity of information, we reserve the right to edit, delete, remove or modify any content at our sole discretion, without recourse to the service user.

5.0 Membership Platform
5.1 Membership
TCBA is a Membership platform  and allows Care entrepreneurs to join its Membership platform as well as order services.

TCBA will not become liable for any transactions, dealings and or interactions with any organizations and/or individuals found on or through our services. This includes, but is not limited to, the delivery of goods and services, and any other terms, conditions, warranties or representations associated with listings on TCBA or any of its affiliate websites. As a platform for Care entrepreneurs our involvement is limited to the provision of the Site for interaction and we are under no obligation to resolve disputes between any parties.

  1. Fees, Payments and Refunds
    6.1 All fees charged for services, events, etc, are payable on order.

6.2 All payments can be made secured from our website.

6.5 Refunds will be provided to clients where there is justification that any delays in service is due to the fault of TCBA. However, where the client disregards the Terms and Conditions of service, no refunds will be made to clients.

7.0 Third Party Services
7.1 TCBA provides care related services. We do also work with associates and third parties. However, our associates and partners may charge fees for their services. When you use a service that has a fee, you have an opportunity to review and accept the fees that you will be charged, which we may change from time to time.
You are responsible for paying all fees and applicable taxes associated with your use of the site. In the event a listing is removed from the service for violating the Terms of Use, all fees paid will be non-refundable, unless in its sole discretion, TCBA determines that a refund is appropriate, in accordance with its general policy.

7.2 Where ever TCBA permits you to link to other websites or resources on the internet, you do so at your own risk. TCBA will not be liable for the content, functions, accuracy, legality, appropriateness or any other aspect of such websites or resources. At the same time, TCBA will not and cannot be held liable, directly or indirectly, for any damage or loss caused.

  1. Content and License
    All users must, to all intents and purposes, agree that the services provided by TCBA and its partner companies are protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any Content accessed through the Service.
    TCBA grants each user of the Site and/or Service a worldwide, non-exclusive, and non-transferable license to use, modify and reproduce the content, solely for personal, non-commercial use.     TCBA does not, in any way, form or shape, set itself out in a special relationship with you or any company in relation to the provision of services.     For these reasons, we do not provide any guarantees, conditions or warranties with regards to the accuracy or otherwise of these materials. We expressly exclude:

11.0 Limitation on Liability
11.1 Except in jurisdictions where provisions are restricted and except as may be required by applicable security laws, in no event will TCBA or its directors, officers, shareholders, partners, employees or representatives be liable to you or any third party for any indirect, consequential , exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your use of the site of the or the service or any of the site content or other materials on or accessed through the site, even if the company is aware of has been advised of the possibility of such damages.
11.2 Notwithstanding anything to the contrary contained herein, except as may be required by applicable securities law or other laws, you shall be limited to injunctive relief only, and shall not be entitled to damages of any kind from any TCBA or its directors, employees, officers, shareholders, partners f representatives, regardless of the cause of action.

  1. Policy on Computer Misuse
    All users of our Site must not misuse it by knowingly introducing or causing other third parties to introduce harmful materials such as viruses to cause disruption or halt the services provided by TCBA.
    All unauthorised access to prohibited sites or access to information/data forbidden by users and third parties shall be deemed as a criminal offence under the Computer Misuse Act 1990. Any such breach may lead to prosecution by the authorities involved.
